ABSENCE PROOF: the terms 'accessory dwelling', 'accessory apartment', 'granny flat', 'in-law', 'second dwelling unit', 'additional dwelling unit', 'carriage house', 'guest house', 'garage apartment', 'accessory residential unit' and the word-boundary token 'ADU' return ZERO matches across every one of those 256 sections (a case-insensitive substring search for 'adu' returns only 'adult', 'adults' and 'viaduct', which is why the token was matched on a word boundary). POSITIVE EVIDENCE that the search was capable of finding such a use: Title 17 defines 'Dwelling unit' ('a portion of a structure used for living purposes which is entirely separated from other portions of the structure by walls and floors...') and enumerates one-family, two-family, four-family and multi-family dwellings as uses, the code has the concept of a dwelling unit and simply never creates an accessory one. CONTROLLING RULE: 17.36.020.B.1 ('No building shall be erected ... nor shall any land or building be designed, used or intended to be used, for any purpose or in any manner other than as specified among the uses hereinafter listed as permitted in the district') and 17.36.020.B.5 ('Where a use is specifically enumerated in a less restrictive zone, such use shall not be permitted in a more restrictive zone unless it is specifically enumerated as a permitted use therein'). Under NJ home rule a use not enumerated is not permitted, so an accessory dwelling unit in Elizabeth requires a use (d) variance under N.J.S.A. 40:55D-70(d). SEPARATELY, accessory BUILDINGS are permitted (17.36.030): up to three one-storey accessory buildings, total accessory coverage not more than 33 percent of principal building coverage, not more than one exceeding 100 sq ft, none exceeding 10 ft in height, set back at least 2 ft from a rear lot line and 3 ft from a side lot line, a shed or garage envelope, not a dwelling.
